THE ROLE AND FUTURE NECESSITY OF ORGANIC LAWS

Abstract

present, the absence of a coherent methodology for interpreting 
organic laws has contributed to conceptual ambiguity between the 
notions of “organic law” and “constitutional law.” Without engaging 
in theoretical disputes, it remains impossible to objectively determine 
the structural rationale for constitutionally mandated legislation. 
By its fundamental nature, the Constitution is not intended to regulate 
all critical areas of state and social life in exhaustive detail. Should the 
Constitution be frequently amended to introduce such detailed 
normative provisions, its scope and content would inevitably expand — 
a development that is neither desirable nor appropriate. To address 
this concern, it is more prudent to regulate the most essential matters 
falling within the purview of the Constitution through separate, 
specialized legislation. 
 
Үндсэн хуулийн эрх зүйн өөр нэг эх сурвалж нь органик хуулиуд 
юм. Өнөөдөр органик хуулиудыг ойлгох нэгдсэн арга барил дутмаг 
байгаа нь "органик эрх зүй" болон "үндсэн хуулийн эрх зүй" гэсэн 
ойлголтыг хэсэгчлэн төөрөгдүүлэх шалтгаан болсон байна. Энэ 
асуудлаар маргаан өрнүүлэхгүйгээр үндсэн хуульчилсан хуулиудын 
бүтцэд объектив шалтгаануудыг тогтоох боломжгүй. Үндсэн 
хууль нь үндсэн гэх агуулгынхаа хувьд төр, нийгмийн амьдралын 
бүхий л чухал салбарыг нарийвчлан зохицуулах зорилготой биш 
юм. Хэрэв Үндсэн хуульд нэмэлт, өөрчлөлт ойрхон хийх байдлаар 
хэм хэмжээг нарийвчилсан тохиолдолд үндсэн хуулийн хэмжээ, 
агуулга өргөжих нь гарцаагүй бөгөөд үүнийг хүлээн зөвшөөрч 
болохгүй. Энэ асуудлыг шийдэхийн тулд үндсэн хуулийн хүрээнд 
хамгийн чухал асуудлыг тусгай хуулиар зохицуулах нь зүйтэй юм.
