SOME LEGAL ISSUES IN THE LETTERS OF MONGOLIAN KHANS (IMPERIAL PERIOD)

Abstract

The article briefly explains the meaning and significance of the 
concept of the “Golden Tether policy” (Altan Argamj), defining the 
historical period, geographical context, and underlying reasons for the 
emergence of this formulation. The authors note that, in its narrow 
sense, the concept of “Golden Tether policy” originated as a symbol of 
diplomatic relations and external trade among the nomadic peoples, 
while in its broader sense, it represents the Mongols’ policy of 
maintaining friendly and mutually beneficial trade and relations with 
neighboring and other countries, aimed at ensuring peace and creating 
a favorable external environment for the nation's security and 
prosperity. 
The article emphasizes that the “Golden Tether policy” and practice of 
the Mongolian state were governed by a detailed legal and regulatory 
framework. 
The authors highlight that the nomadic Mongols played a major role in 
spreading the idea of free trade throughout the world, contributing to 
the creation and security of the Silk Road that connected the East and 
the West, and establishing diplomatic norms and practices that 
significantly influenced the development of human civilization. 
The “Golden Tether policy” has thus become a core value and 
historical tradition of Mongolian foreign policy, which continues to be 
reflected today in Mongolia’s modern foreign policy principles—such 
as the pursuit of peace, non-alignment, and the “Third Neighbor” 
policy. 
Өгүүлэлд “Алтан аргамж” хэмээх ойлголтын утга учрыг товч 
гаргаад уг томьёолол үүсэн гарсан түүхэн цаг үе, орон зай, учир 
шалтгааныг тодорхойлсон болно. Зохиогчид “алтан аргамж 
хэмээх ойлголт нь нарийн утгаараа “элчин харилцаа” болон 
нүүдэлчдийн гадаад худалдааны бэлгэдэл болж үүссэн бөгөөд 
өргөн утгаараа монголчуудын төр улсын  хөрш болон бусад улс 
оронтой харилцан ашигтай худалдаа арилжаа эрхлэн найрсаг аж 
төрөх, улс орныхоо энх амгалан оршихуйн гадаад таатай орчин 
бүрдүүлэхэд чиглэсэн бодлогоо томьёолж ирсэн ойлголт болохыг 
гаргасан  болно. Өгүүлэлд Монголын төр улсын алтан аргамжийн 
бодлого, үйл ажиллагаа нь хууль, эрх зүйн нарийн зохицуулалттай Зохиогчид нүүдэлчин монголчууд дэлхий дахинд чөлөөт 
худалдааны үзэл санааг түгээж Өрнө, Дорныг холбосон торгоны 
замыг бүтээлцэн,аюулгүй байдлыг нь ханган, олон улсын 
харилцааны дипломат ёс горимыг цогцлоолцон хүн төрөлхтний 
соёл иргэншилд оруулсан ихээхэн хувь нэмэртэйг дурдсан болно. 
Алтан аргамжийн бодлого нь монгол төрийн гадаад бодлогын 
үнэт зүйл , түүхэн уламжлал болж ирсэн бөгөөд эдүгээ Монгол 
Улсын гадаад бодлогод энхийг эрхэмлэгч, эвсэлд үл нэгдэх болон 
“Гуравдагч хөршийн бодлого”-д шингэн хэрэгжиж байгаа  болно.
